When you contract Sophisticated Golfer LLC to book any travel arrangement, you have appointed us to act as your agent in securing the requested arrangements for you. The payment of required deposits or full payments for a reservation constitutes consent to all provisions of the terms and general information contained herein. All accommodations, tee-times and other items listed in itinerary tours are subject to availability. All pricing quoted in an itinerary is guaranteed only at the time of booking and once when deposit is accepted. The term "packages" refers to any brochure program or customized itinerary presented. Air Transportation Airfare is included in a group package only when specially noted. Specific group packages include airfare based on special negotiated fares, which have an advanced booking and prepayment requirement. Airfare quotes are subject to change without notice until paid in full. All airfare cancellation fees are dictated by the individual airline. Other restrictions may also apply. Golf Carts & Caddies While nearly all American and Caribbean golf courses offer electric golf carts, some do require/encourage the use of a caddie to accompany you on your round. All golf package rates include a motorized cart unless specially noted. Caddies act as independent contractors paid for separately by each golfer and cannot be guaranteed by a resort, golf club, or Sophisticated Golfer. Golf Times & Weather Conditions Clients of the Sophisticated Golfer LLC are offered preferred /prearranged tee off times. Times are subject to availability and golf course blackout dates. Rain does not constitute cancellation of reservations. Refunds on golf reservations and golf services are only provided in the event that management of the golf service in question has rendered the course unplayable due to extreme or dangerous weather and/or unforeseen circumstances and has closed for business on that day and/or cannot offer any reasonable substitutable play and/or the Sophisticated Golfer cannot offer substitute. Unused Tour Service Tour services included in a customized or prepackaged price such as golf green fees, hotel stays, meals, tours, and ground transportation, etc., that is not utilized or taken, are not refundable. Not Included & Unused Services Unless otherwise specifically noted on any voucher, proposal, or quotation the following are not included. Airport departure tax, excess baggage charges (please check with each airline to ask about excess baggage requirements), laundry, phone calls, meals (except as specified), drinks, items of a personal nature, caddie fees, gratuities or any items not specifically mentioned as being included. Changes Changes are always subject to and based on availability of the supplier's services. A change of arrival date will constitute in a loss of all prepaid accommodation, golf, meal, transportation, etc. up until the new arrival date. If a change in the date of arrival does not fall within the previously confirmed dates, full cancellations policies will apply. Change to the departure date or additional services once all tour portions have been used are always based on availability of the supplier's services and subject to airline flight restrictions and penalties. Deposits and Payment An initial deposit of $300 per person for each travel package is due in order to confirm space and on confirmation of services. Deposits can be paid in the form of check or credit card. Final payment is due on or before 30 days prior to departure. Upon receipt of the deposit the tour arrangements will be placed into operation and the required reservations secured. Unless noted separately all bookings fall under the above deposit requirements. Cancellations Notifications of cancellations must be sent in writing via mail or electronic mail and must clearly state name and phone. Any non-refundable deposits or charges paid for by the Sophisticated Golfer on your behalf will apply from 60 days or more prior to the commencement of the tour under all below circumstances. Fees will be made in accordance with the following schedule: Cancellation on or before 30 days will result in the loss of initial deposit. From 30 -16 days prior will result in the loss of 50% of the total tour cost. 15-0 days prior will result in the loss of 100% of the total tour costs. Travel Protection & Insurance The Sophisticated Golfer LLC highly recommends that you take insurance to cover your investment. In the event of forced cancellation, loss or damage of luggage, personal injury, accident or illness, none of which the Sophisticated Golfer can be liable for. Vouchers Vouchers are valid only for the accommodations and services specified. They are not exchangeable. Vouchers are only valid for the dates specified and void thereafter. Proof of Citizenship It is the sole responsibility of each client to procure a valid passport and or visa when traveling to a foreign country. Failure to meet entry requirements may lead to deny entry to aircrafts or foreign countries. Absolutely no refunds will be made in the event a passenger/client fails to provide proof of Citizenship. Passport requirements for US citizens will change January 1, 2007. Responsibility 1. Sophisticated Golfer LLC acts only as agent in making arrangements for hotels, sightseeing, golf, transportation or any other service in connection with the itineraries of individual golf package clients or tour members who by acceptance thereof, acknowledge that the sponsoring organization and /or it's agents shall not be liable for any injury, damage, loss, accident, delay or irregularity, liability or expense to person or property due to the act or default of any hotel, carrier, ground transportation and or limo service, or any other supplier, company, or person providing or rendering of services included in any vacation packages or tour. 2. The Sophisticated Golfer LLC and or its agents accept no responsibility for any sickness, pilferage, industrial disputes, health risks, reason or war or threat of war, riots, civil strife, terrorist activity, closure or congestion of airports, cancellations or changes or airline schedules nor any similar event, including acts of God, which are beyond the control of the Sophisticated Golfer LLC. 3. Transportation by aircraft, rail, ships or coach will be dependant upon the conditions of carriage of the relevant carrier. These conditions of carriage may be limit or exclude the carrier's liability to you under international law and is subject to the conditions of contract as specified in the passenger ticket and applicable provisions of law and treaty. 4. Sophisticated Golfer LLC reserves the right to cancel, change or substitute any package or tour service if the circumstances so require and are beyond the control of Sophisticated Golfer LLC. Additionally, if any service or its reasonable equivalent service is not provided due to reason beyond the control of Sophisticated Golfer LLC, then the company will make an appropriate refund of that portion of the tour price covering the undeliverable tour service.
